There are at least two things wrong with your question from a protocol
perspective.  First, INVITE is not a response.  Second, the algorithm a
UA uses to generate a call-id should result in a globally unique
identifier.

Now if a UAC has the resources to handle an incoming call while it's
placing an outgoing call, and it doesn't care that the incoming call's
To, From, and Call-ID headers match its outgoing call, answer it.
However, this situation is an error condition for protocol compliant
UAs.  The UAC can decline the call with a 486 Busy Here response and
retry-after header.

I am not very sure of what your concern is:

First when UAS gets a INVITE it usually responds
back with a provisional/ final response...

It is in case if there was no such response from the
UAS.. then the UAC will keep resending the INVITE
which would actually be called as the re-INVITE, which

would be sent for a max of 7 times (32s, for UDP)..


So the UAS cannot send a re-INVITE..as a response to
the INVITE.. there could be a case where before the
INVITE reaches the UAS.. the UAS (which in this case
becomes a client) has already originated a INVITE to
the same party which has already issued an INVITE..so
as to say that both INVITE crosses on the wire, still
it would not be termed as a re-INVITE and obviously it
will have a different call-id.. In such a case both
will get a response of ..other party being busy.
