One layman or a group of laymen does not mean anything, no matter how
smart s/he is / they are. And I am completely confident these
laypeople are not savvy enough to definitively state this is not an
issue in every country. Until the patents expire or are contributed to
an entity that provides indemnification, there will /always/ be
questions and exposure.

Regardless, Douglas answered my question, we can disable mp3 and
ultimately we will have a patent-unencumbered format. Thanks Douglas!
