Getting a divorce is a very complicated process, one that not only
deals with the law, but also with your emotions. What is even more
complicated about divorce is that after a while, things start to
change. Perhaps you begin to get over your spouse's infidelity or
perhaps your partner has gone to rehab and cleaned up their act.
Whatever the case may be, sometimes the legal arrangements that you
set up right after the divorce, are non longer worker, are too strict,
or even too lax. One of the most common issues that divorcees wish to
change is the state of custody for their children.
Steps to Take
If you want to change the legal custody so that you are partly
responsible for the children of your marriage there are several steps
that need to be followed:
' You must prove that there has been a significant change in your
circumstances since the court reviewed your case
' Fill Paper work-You need to write a letter to the marshal, fill out
a motion for modification, request an appearance, a request for leave,
and a fee waive application
' Take all your completed paper work to the clerk's office in the
correct order. Before you hand it in, make sure you have at least two
copies of each form for your own records.
' Contact the Marshal in charge of your spouse's case, and have the
paperwork given to your spouse, thus having them served.
' Have a court hearing in which you present your case. Make sure to be
on time with your lawyer, any witnesses you might have, and all the
appropriate paperwork.
' The court will then have you meet with Family Services, or a Family
Service Officer to help both parties come to an agreement about
custody. If you can come to an agreement, that is great, however, if
some things are still in contention, then you must appear before a
judge with your former spouse to state your case.
' It is then up to the judge to rule on your case, and up to them
whether or not the custody orders should be changed.
As daunting as this process may seem, it is important to make your
children happy. Let them see the changes you have made, and help heal
your life and theirs.
