Hello,

A problem that arose in 1.3.1 and was fixed in 1.3.2 has now returned in
1.3.5, albeit in a slightly modified form. Below I'll just copy almost
verbatim what I posted about the problem the first time around, which
was October 19, 2009:

I'm on 10.6.2. Upon updating to Skim 1.3.5, the checkbox in the prefs,
"Open pane only for Table of Contents" is no longer functional. That
is, when it's checked, Skim opens the side pane for contents/thumbs
every single time a T.O.C-lacking PDF is opened.

I reverted to 1.3.4 and the behavior returned to normal. By
"normal", I mean that when this box is checked, the
contents/thumbs pane will (a) auto-open when there is a table of
contents, and (b) not open when there is no table of contents.

1.3.5 seems to have it backwards. When the box is unchecked, Skim will
open the pane only if there's a TOC. When the box is checked, Skim will
open the pane no matter what, even if I previously closed the pane.
