I see the behavior with any PDFs that have TOCS. It happens no matter how I open them (though I have never even tried the "auto startup from last run"). Double-clicking in the Finder, hiting return in Spotlight, "open file.pdf" from Terminal, and "texdoc somelatexpackage" in Terminal all produce the behavior. I've tried trashing Skim prefs, clearing all caches, logging out, restarting, etc., and no matter what I do, the preference does the opposite of the checkbox. This works on two different machines, both 10.6.2, both Skim 1.3.5.
