Actaully one line of attack, might be to make warranty on software an enforceable thing. Sure this would mean that M$ would have to pay out a bit in insurance premiums to cover there crap software, BUT it would make it remarkably econmomical to release free software if you had an obligation to provide some sort of warranty.
