This may be a case of common property shared by
all and is not unusual in developments of residential subdivisions. You might
question him or another property owner if this is the case for the property on
which the tank sits. Or, you can check with the city/county building
department for a look at the survey plat which usually contains any such
covenants as commonly owned property and rights of way.

was thinking the same thing... I would think that Todd would be
covered under the same one as the tank owner.. Isn't there something
like a common access law when your going to your property that you can
go through another person's w/o fear of trespassing?
Several several several years back I had a friend that used something
like that to obtain a strip of land he bought to put in a road... or someone
used that against him.. can't remember... been up all night fighting
worms...
Just curious but the tank owner doesn't have
an easement to get to his tank?
