<shaking head> Heck ... I don't know... I don't know the laws in Colorado.... I don't know why the heck a DA would attempt to convict a very rich celebrity athlete who can obviously hire the very best lawyers that money can buy with only a shaky case to work with........ Maybe the guy I listened to on FOX last night was an idiot? Maybe the DA is an idiot... Maybe the DA hates black folks... I dunno...

I will make a prediction though.... "This ain't over yet."

But why? Why would it be disallowed. The forensic evidence showed that

not be allowed unless they are trying to railroad him?

I mean it is the prosecutor's witness making these claims. He's under oath
and is having to admit that the case is weak. If Bryant were not famous
would the prosecutor even bring a weak case like this to trial?

Just playing Devils advocate here....

A lawyer on FOX last night had the opinion that all this stuff in pre-trial
that the defense is purporting (even if it *is* rebutle Charles) is designed
to taint the rep of the accusor and much of it will not be allowed at the
real trial. (just another spin)

I'm beginning to lean that way myself. Neil and I were discussing this

the prosecution has presented doesn't show the *victim* in a favorable

The more of the prosecution's case I hear (remember, the defense isn't allowed to present evidence, only cross-examine---this is *ALL* the prosecution's case that took place yesterday) the more I think he's innocent.

If they were already having sex and she said no and he stopped when
she said no, then IMO it isn't rape.

Ok, more stuff is still leaking out of yesterday's hearing. In the testimony the detective said that in one of her interviews with him he asked her if he stopped when she said no, and she said yes. That could account for the lack of his semen. (i.e. he didn't finish). Now, if she said no (that's in question) and from her own testimony he stopped....is that rape? Isn't stopping what he's *SUPPOSED* to do?

Maybe we shouldn't do this sounds like she wanted to be convinced that
it was ok..that he might care for her afterwards or something to me. I
think she got what she wanted...and then had second thoughts after he
didn't want a relationship with her afterwards. She is young..but she
obviously had sex before...and from what we are hearing now, quite a
lot of it.

No, but it does have bearing on whether he raped her or not. If she
herself doesn't remember if she was clear in saying no, then that
matters don't you think? What if all she said to him was "Maybe we
shouldn't do this", is that clearly no?

That has nothing to do with weather or not she had sex after Kobe.

Did you see number 3? If the victim is not clear that she made no clear to him how could he be expected to know? Stephi

On the stand in testimony... 1) Detective said their was male Caucasian pubic hair and semen in her panties from another man. These are the panties she wore to the hospital. 2) Victim says no sex with no one for 4 days before Kobe (ok, if that is true, why was she still wearing the panties Ugggghhh) 3) Detective says that the victim was unclear if she made it clear she said no.

=====
I wanted a perfect ending... Now, I've learned, the hard way, that
some poems don't rhyme, and some stories don't have a clear beginning,
middle, and end. Life is about not knowing, having to change, taking
the moment, and making the best of it, without knowing what's going to
happen next.
Delicious ambiguity.
