I have the same drive, I'm on Solaris 10, and I found this thread after a lot of googling.

Assembled 30 March 2009 removing the drive, looking at model/revision/firmware info etc. I discovered I don't suffer from the firmware problem as I'm using a later revision of the firmware prefixed with 'CC'. I added the new drive, did the "touch /reconfigure" and rebooted, it didn't pick it up.
