Thanks you for your input Mr Darling.
Its tough to convince conservatives who believe that
government shouldn�t do anything but sit on its hands
until some nuts blow something up, that government
does have a role in looking out for its people but,
I�ll try:
1.A business does own the property but not in the
sense
that a homeowner does. There is an agreement with the
city on what type of business will be conducted and
many regulations with that type of operation.
It�s why we have a license and inspections department,
to make sure your business is doing business that way
WE have agreed it should be done in St Paul(that's the
key). Businesses that don�t like that are free to go
to Minneapolis or South Dakota.
We regulate grade of meat, capacity inside venues,
weight limits on elevators, hours of operation,
citizenship of employees, disposal of waste and other
things for the safety of our consumer/citizens. If it
is proven that second hand smoke is enough of a danger
that it drags (no pun intended) on the quality of life
or health of more than that one citizen that is
getting pleasure from it- then something needs to be
addressed.
Smoking is not a right, owning a business is not a
right, they are both regulated priviledges.
Individual rights do not trump on the rights of the
collective. Government is there to be sure the
collective rights are intact. The Bill of Rights
addresses our individual rights. Which leads me to the
second part of this.
2.You ask where the candidate Ortega gets his power to
push for a smoking ban, and then you tell us to read
the Constitution like you have. Your problem in
reading the US Constitution and Minnesota Constitution
is that you haven�t read enough of it. Follow this:
a)The 10th Amendment to the US Constitution gives
powers not delegated to the United States by the
Constitution, nor prohibited by it, to the states are
reserved to the states respectively, or to the people.
b)Article XII section 4 of the Minnesota Constitution
allows our local government to adopt our own home rule
charter.
c)Sec. 3.01.of the St Paul City Charter says the
executive power shall be vested in the mayor. Ortega
is running for Mayor (hence, where he may get the idea
that he�ll be constitutionally within his duties). He
supports a smoking ban. Simple as that.
Mr Darling goes on to say: �I ran for Congress once so
I have the credibility to make this next statement.
Please read at minimum the US Constitution and the
Minnesota Constitution before making the decision to
run. If you cannot agree with the basic doctrines
this nation and state were founded on, please do not
run until you are able and willing to hold your
governance within those basic confines.�

I say that you need to stop skipping the parts you
don�t like and when you�re really ready to talk about
abuse to the Constitution, lets discuss the President.
Then we can discuss the disposal of the 1st, 4th, 5th,
6th, and 8th Amendments under George W. Bush.
