Hmm, I keep hearing this from different people but I don't
think it is true.
  Here is a quote from a typical licence agrement. In this
case from a copy of Microsoft Windows 3.0 taken at random
from my shelf.

" 5. TRANSFER RESTRICTIONS. This SOFTWARE is licenced only
to you, the LICENSEE, and may not be transferred to anyone
without the prior written consent of Microsoft."

That seems pretty clear to me.
