Another flaw is the complete inbalance between magic users and melee-types. Spellcasters really get the shaft in this game.
That depends on how you build your character. My wife played the mage-type where you need to be attacked by magic to 'recharge' your own magic. She did quite well in the game that way. She did play through Arena with the same type of character so that may have made the difference.

I guess I'm not understanding your point. Are you saying that the system should be rigid enough to stop you from making that choice? If you are then you're really wanted 1st or 2nd edition (A)D&D where you can't do quite a bit. If you want a system flexible enough to allow lots of player options then you have to let the player make these types of mistakes.
