If you make blocking behavior customizable per customer, ie. the customer can deliberately decide he doesn't want to receive any mail that matches "common swiss spam patterns" (or however you'll call that ruleset), I don't see how that could be illegal? Unconditional filtering of mail based on probability is not something I'd consider to enable...
