actually, I have used
   warterway=spillway
   intermittent=yes
in the past, reasoning that this particular spillway (http://www.openstreetmap.org/way/451309286) is rarely put to use, while others might be more permanently flooded (regularly during high tides for example)

    I've seen these tagged as waterway=drain which is close but agree that
    waterway=spillway is better. Would be great to have this documented on
    the wiki.
