Because you're reading too much into the name. All the highway tags were initially made up to end in '...way'. So forget you're ideas of what a "footway" or a "footpath" or a "sidewalk" or "pavement" or "path" or "pathway" or "driveway" or "towpath" (or "freeway") mean outside OSM, since they don't correspond to OSM highway types, even in the cases where the name is used.
