I think the attitude of Councils varies a bit from place to place. For example, two Councils (qua Highway Authorities) that I deal with on a very regular basis both state that the definitive map data is available for public use so long as we do not actually copy the underlying OS base map.

By law all Councils have to make the Definitive Map (and Definitive Statement) available for public inspection at their offices.

Many Councils will also have various publicly available databases that they have created themselves that are contain no actual mapping at all (but might contain OS grid references rather that latitude and longitude as a means of defining locations).

Congratulations on taking the initiative that you have, as greater clarity would be most helpful in view of the fact that the Public Sector Mapping Agreement is now in force.

Council contacts are absolutely clear that OS makes no claim to PRoW data - they access it from the Highway Authorities in the same way as anyone else and are allowed to put it on their maps (although they add careful legal disclaimers as to its non-authoritative status).

    Does anyone have any ideas on how to actually get the councils to
    apply to OS to exempt their data and release it? Currently, I get
    the impression that they don't rate data openness as a high
    priority - they just nod and smile until I go away. It would be
    good to get this data for quality assurance or even ... dun dun
    dunnnnn... importing. Could we start a petition? Or use any

    sets worth liberating?

    Once we have set a precedent, it should be easier to get other
    councils to comply, because of the way the OS exemption process

Technically I believe that the rights of way on the OS mapping is derived from the legal documentation provided by the council. As it happens I was talking to someone who was in a position to know about this recently and he said that the OS don't even claim ownership of rights of way data.

Also. my understanding is that Kent are particularly proactive on open data. This youtube presentation is worth looking at even though it seems to be about their map interface. Clearly they are talking the talk on open data.
