The PD check box is purely advisory, see http://www.osmfoundation.org/wiki/License/We_Are_Changing_The_License#What_Are_The_Choices.3F

Note that the CTs guarantee that required attribution will survive any future licence changes (or data with such requirements would have to be removed) so the likelihood of a switch to PD actually happening is negligible. Despite the amount of FUD that continues to be generated on exactly this point.

Yes, most certainly.

The Contributors Terms, says: "You hereby grant to OSMF a worldwide,
royalty-free, non-exclusive, perpetual, irrevocable licence".

So the public domain checkbox isn't that important.. :-)
