If freenet gets very bad in the eyes of the law, then they will find
a legal way to nail it anyway.  I think that if freenet is designed
in a perfect way and there is absolutely no way to remove data from
it nor to track where data is stored; then courts would (rightfully
imho) make it illegal to run a freenet server a priori.

I'd like to hear from lawyers before designing something that is
intended to by pass laws - we might not be able to do it the way that
it is attempted right now.  Think of what will happen when everyone
starts to upload the latest CD singles as mp3s, videos, child porn
and warez.  Would freenet survive the legal attacks then?
