With due respect sir, no, they couldn't have. Marvel placed up the rights to several of their characters as collateral for the capital to produce Iron Man; if it had tanked they would have been in dire straits. The strategy they used to get Iron Man filmed was discussed quite a bit due to the risk the company was taking.
