They do?  Remember, it was the FCC that came up with the idea of using
the Mobile Satellite Service L-band downlink spectrum for terrestrial
broadband service in the first place (setting the stage for the
LightSquared debacle).

That's why the FCC granted a "conditional" waiver of the rules. It was politically expedient, and I would imagine that the engineers at the FCC thought "there's no way they'll be able to demonstrate no interference"
