Yes you can create software package from FOSS, but you can charge for CD's, 
manuals, box, distribution, prepaid support hours (...), but not the software 
itself.

Any agreements between developer and customer are not strictly binding as the 
code is FOSS, so upon creation it belongs to no one and everyone at the same 
time (read GPLs, their FAQs and expert thoughts about this). 

Anyway (most of the time) all the code developed, is allowed to be recreated by 
developer ( at least from memory), as no one can prohibit people to recreate 
their work for someone else. It was in middle ages when craftsmen have been put 
in prison (...), in order not to recreate the masterpiece.

Yes customer can ask (rightfully) to hand over all the materials, manuals etc., 
created during the development process. There could be numerous patents on 
technologies used, but remember patents are not recognized all over the world 
equally. Patent use in FOSS software have been discussed long ago, most of the 
time it is not worth using them. So this becomes nonsense after all.

In a case of GPL software, the maximum one can achieve, is the priority in 
time. If you can outrun others by means of several years (as this is practical 
lifetime of software), you have got all what is possible.

Everything else is just a speculations and "dirty" :) games. One can do all 
what he wants until he has been caught somebody more powerful than him, this 
does not make one more right or not.
