I don't think its a anything a firmware update can help, it was never designed to play music while a scan is happening. The scan uses up almost everything the little box has, so doing anything else while its scanning can cause very flaky results. The big problem is that it doesn't tell you in big bold letters, Scanning, don't touch the Touch! If it didn't let you do anything while scanning, many of these problems would go away.
