The battery voltage is significantly higher when being charged than when discharging. You need a battery with a higher nominal voltage (and preferably a regulator - but as I assume the reason you are trying a battery is some audiophile purpose, a regulator might or might not fit your plans). Just watch out the voltage doesn't get too high when charging - not worth blowing up your Touch. "To try to judge the real from the false will always be hard.
