I had issues with a brand new sealed-in-the-box Touch last year when I first used it. Immediately it wanted to update. I had all sorts of issues following the update (documented on this forum somewhere). Eventually, I let it download and re-install the firmware update, all problems vanished. The original download had issues, after doing so again, no problems at all. Try it?
