What happens if this ‘extra’ data is received and it causes a syntax error?  Do you process the transaction or ignore it?  By definition the transaction must be HIPAA compliant to process.  All kinds of fun issues.

My read of the reg says yes, one can assume that all payers will accept taxonomy codes even though they don't require them.  Source of understanding is below.

"...(3) A health plan maynot reject a standard transaction on the basis that it contains data eleents not needed or used by the health plan (for example, coordination of benefits information.)"
