As a TPA for self-funded employer groups, our company is considered a "business associate." We filed an extension for all our groups for EDI.  However, for privacy compliance, some of our employers who would be considered small groups and be eligible for an extra year to comply are also considered health providers (small hospitals, physician offices, etc.)
and are required to comply with the Privacy Act in April 2003.  As business associates of health providers, does this mean our TPA is required to be compliant with the Privacy Act in April 2003 or April 2004?
