Yes Jonathan, as a provider you are not required to comply unless you submit electronically. Only the health plan is required to have the capability to receive or send electronic standards. Below is a quote of the HCFA Final Rule : "We phrased the applicability section in the proposed rule as we did in an effort to convey the message that these regulations do not require a health care provider to transmit transactions electronically; thus, a health care provider remains free to use paper media. These regulations do require, however, that a health care provider who uses electronic media to transmit any health information in connection with a transaction referred to in 45 CFR subtitle A, subchapter C, must do so in compliance with the regulations. >>> [EMAIL PROTECTED] 10/10/02 12:27PM >>> I work with a dermatology office(with fewer than 10 FTE)who currently files eletronically ONLY to Medicare. They have no other insurance contracts. The practice is considering switching to paper claims for Medicare to avoid the HIPAA regulations (Transactions and Code Sets and Privacy). As they currently submit eletronic claims to Medicare, will making the switch to paper make them exempt from the HIPAA requirements? Thank you for your responses.
