Council Directive 91/263 in its Article 9 gives the two conformity assessment modules one may choose from, to whit: EC Type examination Declaration of Conformity EC Type examination is described in Annex I, and does not make any mentio= n of a quality management system being in place. I presume that the Notified Body under Article 5 of that Annex may pose a Quality Management System as a condition for the validity of its EC Type-examination certificate. Article 2 of Annex II only requires that the manufacturer shall take all measures = necessary to ensure that the process assures compliance, not IEC-9002. (Admittedly, you'll have to have in place something like an IEC-9002 syst= em if you're going to do it). If you pick the option in Annex III, than you have to have an "approved" quality system in place. Same as when you pick the option for Annex IV. Once you have fulfilled the requirements of the TTE Directive with the Notified Body of your choice and applied the CE Marking, under Article 5 of the TT= E Directive, the Member States shall not impede the placing on the market and the free= circulation and use on their territory of terminal equipment that complies with the provisions of the Directive. = Ergo, if BABT insists on an IEC-9002 Registered system, it is going beyon= d what the Directive asks for. You should shop around and see whether you can find = a more accomodating Notified Body to fulfil your obligations under the TTE. The TTE Directive is dying anyway, to be replaced by the CTE Driective th= at no longer requires 3rd Party certification, or compliance with harmonized standards= =2E In the interim, under the terms of the EU-US MRA, the Member States will recognize ISO-9002 Registrations provided by US Registrars.
