 I agree with the responses stating TBR 21 requires new application if
upgrading and relabeling to V.90.   But, I just upgraded software of 6 US
56K modems to V.90 via the web.  They are from 4 different mfgrs and use 3
different chip sets.

Out of curiosity and to insure there were no problems I checked upgrades
against Part-68 & 15.  All passed easily.  Although one had slightly higher
EM, but still easily passed.  Passing may be the function of conservative
designs.

I'm not sure how ETSI views a customer upgrading via the web.  Obiviously
the labeling still indicates 56K.  But, I don't see how remote upgrades of
installed modems can be prevented or controlled.

I plan on upgrading and testing several existing 56K/TBR 21 modems in the
next few weeks.  My designs are so conservative I don't think it will have
much effect.

It's my understanding if a 56K label is changed to include V.90 a new TBR
21 application is required.  And in some cases retesting before it can
imported and/or sold.
