Case 3 is different from Case 1.

Case 3 only covers radio equipment which don't
fall within the scope of Directive 98/13/EC.
Otherwise,
It has to comply with either Directive 99/5/EC (Case
1)
or 98/13/EC (Case 2).

As far as I know, for the first 2 cases,  it is
requested
to clearly specify which Directive has been applied in
the documentation of the equipment to avoid the 
confusion of the meaning of the CE mark.

In the 3rd case, the documentation should mention,
that the CE mark indicates that the equipment complies
with the EMC (89/336/EC) and LVD (73/23/EC) Directives
and not with Directive 98/13/EC or 99/5/EC.

It is NOT correct to state that as of April 8 2000
notified
bodies under Directive 98/13/EC would legally not
further
exist. 

If my understanding is wrong, pls correct me.
