As long as the ESN (Serial Number for activations) is clean (Not lost or stolen or property of Sprint's Insurance program), you can use the phone on any account. Make sure you buy a phone with a clean ESN off eBay. If the seller is nice enough to give you the ESN, you can nicely call into Sprint and ask them if it is clean. Then ebay away! Advanced: You can buy a phone with a Bad/Dirty ESN, and then also buy a new Radio circuit board for the Phone (which will have a new clean ESN), and open it up, toss the radio with the bad esn in the garbage, and install the new radio with the new ESN. Note that the sticker under the battery will have to be ignored.
