It turned out that proving polygamous marriage back then
was almost impossible. Rather than enforce the Morrill Act, which made
bigamy punishable by a $500 fine and up to 5 years in prison, federal
prosecutors used a Utah law banning "lewd and lascivious cohabitation." This statute carried a sentence of 6 months and was the punishment handed out to most pioneer polygamists. Apostle Lorenzo Snow served 11 months. Rudger Clawson, later an
apostle, was sentenced to 4 years for multiple offenses.
