To create a fundation, we need to put something in it. We (B2CK) propose
to put in the fundation the Trademark and the domain name that we own.
About the defence of the licenses of course you need to be a copyright
hoders to enforce it. But this doesn't prevent the fundation to help to
protect it for example by advise, give money to copyright owners.

I don't see the usefulness of such limitation. Especially if the
donators don't become member by just donating.
