Not even close to the same thing.  The VCR pause button was only
capable of stopping the tape - if you were watching a show as it
aired, the video would continue and only the recording would pause.
TiVo's patent covers the ability to "pause live TV" (which is possible
thanks to hard disks, digital video, and a 1/2 second lag) -  which
Dish brags about constantly in their commercials.

Honestly, I find it hard to believe that Dish, knowing that DirecTV
has a relationship with TiVo, would be willing to take the nuclear
option here, especially since it's customer service suicide.  But then
again, stranger things have happened...
