I heard that it has to do with the affiliate ownership. The Fox stations are independent so they want the local news at 10pm no matter what. Fox will always preempt shows, although having "The OT" as a buffer makes it less likely.
More CBS affiliates are "owned and operated" so CBS can push back the news.
