Media companies tend to have litigation insurance, mostly to defend libel
and defamation lawsuits. If you have litigation insurance and get sued, the
insurance company provides the lawyers and pays settlements and court
judgments. They also have the power to demand changes to be made in order
to protect yourself from further lawsuits - and if you don't do what they
say they drop your policy. They also decide on whether to settle and how
much to pay out. If this is the case the question of whether O'Reilly stays
or goes may depend on the insurance company.

If FNC is handling all of this in-house, their whole legal strategy is in
the shadow of how they handled Ailes and those settlements. I don't think
the O'Reilly lawsuits come from recent conduct. I think the offenses
happened during Ailes's reign and female employees feel empowered to seek
justice following the Ailes case. So the question is how many women feel
they have a case, and can find a lawyer who agrees, who have not yet come
forward. FNC cannot let any of these cases go to trial because there is a
discovery phase where they have to open their books to the plaintiff's
lawyers and any wrongdoing tends to get leaked to the press. So how many
more lawsuits do they want to go through?
