According to your screenshot, your hard disk is not in fact empty right
now, in the sense that it contains partitions. We don't distinguish
between a partition containing an operating system and one that doesn't,
at the level of this particular choice - I think this is enough of a
corner case that I'm happy to call that by design.

[Jaunty and Karmic] the installer by default proposes a wrong size for the
Ubuntu partition (far too small)
