I've tested the command below both with an unpatched and a patch Debian 6.9.7 kernel. The test hung as expected with the unpatched kernel, and succeeded with the patched kernel.
There was one gotcha here: I didn't bump my kernel version upon rebuild, so when the test started, the original kernel was installed again (as an upgrade), the VM rebooted, and the test hung again. I sidestepped this by reinstalling the rebuilt kernel, and setting the hold flag. @ Kip In the test log you most recently attached, the kernel version is Ubuntu 6.8.0-36.36-generic with build date June 10, so I don't think this is your rebuilt kernel? Side note, Ubuntu kernel's source package format is 1.0, not 3.0 (quilt), so that's why your patch was ignored in your previous build.
