I reviewed the diff and build log at

for 6.8.0-38.38ubuntu1+kip1

and again I do not see evidence of the patch applied when looking at the
diff.

I attempted to do an "Ubuntu style" git-based build here but the tooling
eventually defeated me die to hard-coding GCC v13 in the build scripts,
where my linux-builder nspawn container (Debian Bookworm) uses GCC v12.

The build instructions for Ubuntu are found at:

But as I only build mainline kernels using the mainline build system I
have neither time nor inclination to delve deeper into Ubuntu.

I am sure, however, you're making a mistake at some point and the patch
isn't being applied in the builder.
