Yes, I am 100% saying that. As a driver I was taught defensive driving. You don't just watch the moving traffic. You predict that even if you have the right of way, people are going to do the wrong thing. I would think in most cases (in the reason I asked him), that it falls under comparative negligence. The parker should look before they get out but the biker should have been more away of his surroundings.
