Just because Ray and Tom and I have subscribed to UC-list doesn't make
it "public" in a legal sense. It is public in many other senses that I,
as a news professional, will attest to. But it is not "public" in the
sense that matters for zoning issues. To borrow Glenn's language:
UC-list is a clubhouse. My advice to partisans who wish it were
otherwise is: quit fooling yourselves; adjust your strategic message
accordingly; and move on.

shca's public process, he said nothing about which neighbor's voice
counted more or less. in fact, he said "all comments will be taken
into consideration".

and when tom lussenhop subscribed to this list, we said nothing about
which neighbor's voice counted more or less. n fact, it was his choice
to privately email people on this list in response to posts they had
made, his choice to meet with people, privately over coffee, to
discuss his proposed hotel.

on wednesday night shca hosted a public process, governed by their own
ground rules, in which lussenhop and the neighbors were allowed equal
time to present their points of view, publicly. the neighbors and
lussenhop honored that process, publicly, and now shca must honor the
outcome, publicly.
I can see how some people aren't happy that wednesday's meeting was
such a clear and irrefutable demonstration of public opposition to
lussenhop's hotel, or that the dp published this -- but I can't see
how anyone can equate that with ad hominem onlist, or how resorting to
ad hominem onlist now can possibly change what happened publicly.
