Neighbors, Those receiving bogus trash tickets recently, are probably getting the new $50 dollar letters. Mayor Nutter signed the new amount starting July, 2009. I know many of you, not on the district hit list, have simply been paying your occasional bogus tickets. I'm already on the weekly harassment list, and after today, I expect to start getting daily tickets. (I don't know what the 10-day late fee is, but it is probably doubled to $100 if they follow the former pattern.)
It will cost $338 to file in common pleas court. In order to get an injunction to stop more harassment being filed against citizens via municipal court, the case needs to be heard in Common Pleas Court. I picked up the filing instructions and set up my e-account today. (The city is wasting tax payer money with a new trick, so today, I just had the $984 dismissed for failure to properly serve. Had I not shown up, I would have had that judgment entered against me. The Bureau of Administrative Adjudication is filing the court action against citizens, and then not having people served by the court! Unless the city's filing fees are waived, in order to facilitate the city's oppression of citizens, taxpayers lost about $50 on me with this idiocy. It could be the usual dysfunctional idiocy, or they could be doing this knowing that most people don't know the proper court procedure and pay in terror.) Class action is very expensive and I don't know how to do it myself. If any of the lawyers on the list know of any colleagues wishing to take similar action on the trash tickets, please refer them to me! I gave a complaint to Councilman Green today, but I'm going ahead with my own lawsuit in the mean time. (I hadn't gone to him before, and Green seems to be one of the few officials in city hall that cares at all about Philadelphians) The people can win in court! The city officials have known about the range of abuses for several years and not stopped it. A court ordered injunction against further harassment is necessary because a political solution has failed. I've got a lot of research to do. Please refer me to any other parties wishing to initiate court action. (I will protect your identity so that you won't be targeted for retaliation.)
