Do you mean a <channel> tag in a [fragment-]layout.xml file? That's the
customary way to do what you're after.
Here's a breakdown of how I would do this task:
- Use <xsl:value-of> somewhere within the Universality theme to place
the portlet just where I want to (see tips, emergency-alerts for examples)
- Add the portlet to a DLM fragment using a <channel> element within
a header folder (with hidden=false) within a fragment-layout.xml file
(see tips, emergency-alerts for examples)
- Make sure "allow expanded content" is turned on (for uP3; it's on
by default in uP4)
- Make sure your users are in the audience of the fragment
That's essentially it. I believe your portlet should recognize and
honor the user's state.

We added a home-grown search portlet to the layout so
all users will have access to that portlet on all of their tabs. The
default view comes up just fine but when a user actually tries to search
for something, the results are not displayed. We can workaround this by
simply adding the portlet to the users' layout which I believe causes
the portlet to not be loaded as transient.
My question is, can a transient portal have and respect states so the
search results are shown? If so, what's preventing our portlet's state
from being updated with the users' search results?

IIRC, a transient portlet (or channel, earlier) is one that's not in
your layout. There are many circumstances where a user can
essentially 'leave' his/her layout and go instead to a specific,
named portlet. In such cases, the framework wraps the single
portlet in some form of transient layout node.
