That would royally suck. Currently, an inventor doesn't have to patent
anything, they can take the risk and just develop and market their
product. First-to-file would eliminate this and make patents
mandatory. I wonder if it would even be constitutional.

If it's already in the market, then it exists as prior art and cannot be
patented by someone later.
