I would just note that trying to establish a price based on the use of a DVD by 
an institution really isn't going to work.  The average DVD may circulate 26 
times a year, as in John's figures below.  Does that mean that if I buy a DVD 
for our library and it never circulates at all, the vendor will refund our 
money?  Or, conversely, that if a specific DVD circulates 150 times, I should 
send the vendor an additional payment?  I don't think so.

Plus, there's the old DVD/book analogy:  I buy a book.  The publisher doesn't 
set the price based on how large the library is or how many uses it may or may 
not have; there's simply a set price for a book.

I liked someone's earlier suggestion of having a lower institutional rate 
($100) and a higher home use one ($50).  But the most fair thing, of course, 
would be to set one price, period, unless, of course, someone wants to purchase 
ppr.

In reference to you question about how often a typical DVD is used, I have 
crunched the numbers based on our institution.

We have 4 fully functioning campuses and are the 3rd largest (based on student 
population) University in British Columbia, Canada.
We are Subject to Canadian Copyright Laws, therefore we must acquire PPR 
(Public Performance Rights) for each and every program we use in a classroom 
setting.  (IE. Educational Pricing.)

Typically a DVD is used 1-2 semesters a year, by 1-2 instructors a semester for 
Educational Instruction.
It may also be referenced by 1-4 students from those classes.

Lower Side - (1 x 1) + (1 x 1) 1 = 2 uses a year                     Total 
Yearly Average Use = 20 Times
Higher Side - (2 x 2) + (2 x 2)4 = 18 uses a year                    Total 
Yearly Average Use = 20 Times

Throw in Academic Research use/presentations is on average 2-6 times a year.

Lower Side - Total Yearly Average Use = 2 + 2 = 4 Times a YEAR
Higher Side - Total Yearly Average Use = 20 + 6 = 26 Times a YEAR

I want as many people to see my film as possible, and if I could afford it, I 
really would give it away. (For me, its really about keeping the memory of a 
murdered person, Vincent Chin, alive.) But I just can't afford do that 
financially.

I guess it boils down to finding a price that both the buyer and the seller 
feels is fair. For us, we charge $245, but that includes all taxes, 
shipping/handling, etc. It also includes a research guide that does not come 
with the home version. With our film, even if we sold 500 copies (which would 
be a dream), we would not even recoup the cost of production, let alone 
marketing. (With docs there is no box office sales to speak of)

Now in terms of a DVD lasting more than a year, just out of curiosity, how 
often is the typical DVD being "rented" or used by the school? It should last 
several hundred views. And if it is being used that much, isn't that a 
testament to the value of the film as an educational tool? And doesn't that 
support the notion that the schools should pay a fair market value for it?

I know I am a newbie here and at the risk of alienating folks, I need to
speak up for the filmmakers perspective.

Trust me when I say, we filmmakers are not trying to get rich off our
projects. We just want to make a living and to be fairly compensated for our
work. Often times, we embark on our films because they are subjects that
personally matter to us, in my case, it was a family friend who had been
murdered, and we devote years to it without getting any monetary
compensation. We are just trying to recoup our costs.

Now, why the price difference? It's because you will be showing these films
as often as you like (for years) and you will be making money off our work
through tuition and other fees. If you amortize it, it's still a pretty good
deal for your institutions. Would you prefer if we didn't offer the home
version and just had the one institutional price?

And to show a "home" version when it is specifically stated that is not the
intended purpose, I think is morally wrong, just like downloading
copyrighted video or music off the internet. But then, again, some people
have no problem doing that either. So I suspect that I lot of people will be
doing that. The loser in that is the artist. Sigh.

In the end, we are all trying to help educate the population. We share a
common goal and it's wrong to think we are your adversaries.

I have no problem paying a reasonable price for a program.

Since in your eye, we have the item for use for years and years, then you need 
to sell it on a media that lasts years and years.

Since DVD's rarely survive a year of academic/student use, it sure would be 
nice if Filmmakers/Vendors provided (free or for shipping costs) replacement 
copies for damaged media formats.

Also: if some of you were thinking of the educator pass, but couldn't
decide or were sold out, there are a few back, however at $150 price
now. Still, if you missed out on an ALA preconference but still have at
least Friday free, its well worth it, and cheaper then most preconferences.
