Illegality matters little if no one cares to enforce the law.

It's legal to beat your wife on the courthouse steps on Sundays in South
Carolina, but you'd better believe that if someone did it there would be a big
outcry.

Additionally, if copyright is assumed to be in place for defence of revenue
streams, any company in the NeXT market would have a really hard time
supporting a copyright argument in court, especially if said company refuses to
legitimately sell the software.
