I have gotten this as well, but it's very rare and typically if I then repeat my request to call whoever it is I want to call it will then be fine. It's the same when my phone is locked and I use my wired headset to ask Siri to call somebody, sometimes I get "You have to unlock your device first". This of course is nonsense so usually I just ask again and it then works. To me these are minor glitches, but the issue with the magic tap being relatively unreliable hopefully gets more attention and a fix as long as enough people contact Apple Accessibility about it.
