In other words, if there are conspirators, they already got away with it. Why bother with a fall guy now? Why stir up any press coverage of the murder?

If New York Times editorials were shrieking that Mallove was killed by energy companies, then conspirators might be looking for a fall guy.

Such considerations do not appeal to the minds of people who believe in conspiracy theories. They are immune to rationality.
