I'd guess they just use the driver if S3TC is supported and can't use
DDS otherwise (or do you know they have a fallback in case the driver
doesn't support S3TC?).

Depends on 

a) The license of the videos. If they are not derived from anything in
the GPL data (*), the creator can choose which license he wants to use and
which format(s) he wants to provide (of course, I'd prefer both to be
open, else we might face the same problem again).

(*) Of course one might argue new videos are derived from the
copyrighted original videos and thus illegal. Yeah, call me a spoil
sport; I don't like all those copyright issues, but I do know about
them.

b) The software the videos were created with (I guess nobody will create
new videos completely out of hand-drawn frames). For example, in case
Blender was used, the .blend file and all resources needed by it should
be available somewhere. (Again, the tools of creation should be open, so
later modifications are possible. Everything in my opinion, of course.
And right now, it doesn't seem likely that someone will make new videos,
or did I miss something?)
