Where is the text of the license that states this? Anyone know?

Since the development tools are now OpenSource, is Apple able to

No.
The WebObjects frameworks from Apple are in reality a runtime.
There are no Development Tools for WebObjects delivered by Apple
any longer (excluding the new nightly builds I guess).
Except that you can't really use the development tools without
linking to WO frameworks, which Apple CAN control (well, you can,
but they're not very useful).
